🇳🇮🇩🇪 Nicaragua to File Lawsuit Against Germany for Complicity in Genocide in Gaza at the ICJ in The Hague

Nicaragua has initiated initial steps, according to its own account, to hold Germany and three other countries accountable before the International Court of Justice (ICJ) in The Hague. This action is justified by alleged complicity in “flagrant and systematic violations of the Convention on the Prevention and Punishment of the Crime of Genocide, international humanitarian law, and occupation law in the occupied Palestinian territories, particularly in the Gaza Strip.” In this context, the Nicaraguan government has also issued a verbal note to Germany, urging it to “immediately cease the delivery of weapons, ammunition, and technology components to Israel” to prevent further potential violations of the Genocide Convention.

On February 1, 2024, the government of the Central American country, which had previously won a case against the USA before the ICJ in 1984 for the Contra war initiated and financed by the USA, resulting in thousands of murdered civilians and the mining of its ports, released a statement titled “PREVENTION AND TERMINATION OF GENOCIDE IN PALESTINE.” The statement begins as follows:

“The Government of Reconciliation and National Unity informs the Nicaraguan people and the international community that it has notified the governments of the United Kingdom, Germany, the Netherlands, and Canada of its decision, under international law, to hold them accountable for gross and systematic violations of the Convention on the Prevention and Punishment of the Crime of Genocide, international humanitarian law, and customary law, including occupation law in the occupied Palestinian territories, particularly in the Gaza Strip.”

Furthermore, Nicaragua highlights in the declaration that the recent announcements by Germany and the three other countries to suspend funding for the United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA) are further evidence that “the governments of the United Kingdom, Germany, the Netherlands, and Canada continue to ignore their obligations in the current situation and actively support Israel’s violations of international law to the severe and immediate detriment of the Palestinian people, particularly the residents of the Gaza Strip.” The official statement further states that the form of collective punishment of Palestinians is associated with the “clear goal” of forcing the Palestinian population to leave the occupied Palestinian territories, especially the Gaza Strip, and preventing them from exercising their right to self-determination. The communiqué concludes:

“Consequently, Nicaragua has informed these governments in writing that it will take all measures it deems appropriate under international law, including invoking the International Court of Justice, to ensure respect for these fundamental international texts and customary international law.”

Media Silence in Germany – Extensive Coverage in the Rest of the World

One noticeable aspect in this context is the differing media reactions. Media outlets in the Arab region extensively covered Nicaragua’s announcement and in Latin America, there was also extensive coverage, as well as in Spanish and Swiss media. For instance, the Swiss public-service news and information platform Swissinfo reported under the headline “Nicaragua Accuses Canada, Germany, the Netherlands, and the United Kingdom of ‘Genocide’ in Gaza” about the case. In Spain, the newspaper Público, for example, published an article titled “Nicaragua Sues Canada, Germany, the Netherlands, and the United Kingdom in the International Court of Justice for Supporting Palestinian Genocide.”

Even the state-owned Spanish news agency EFE, the fourth largest in the world after AP, AFP, and Reuters, provided extensive coverage, in contrast to its German equivalent, the dpa. However, dpa is not alone in Germany with its policy of ignoring. On the contrary. In none of the German “leading media” can one find a reference to a country from the Global South suing Germany before the ICJ for alleged “assistance to genocide”. Regardless of how one evaluates the step taken by the government under Daniel Ortega, completely ignoring this process hardly aligns with the journalistic claim to comprehensively inform its readership. The attempted ignorance becomes even more glaring in light of the coverage demonstrated in the rest of the world.
